Terms of Service
These terms govern your use of ToolStep. Please read them before relying on any review, comparison, or recommendation on this site.
Welcome to ToolStep ("we", "us", "our", or "this site"). By accessing or using our website at toolstep.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms are a legal agreement between you and ToolStep governing your use of the reviews, comparisons, best-of lists, alternatives, and any other content published on this site.
1. Acceptance of Terms
By accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms in their entirety, you may not access or use the Service.
2. Changes to These Terms
We may update or modify these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after any change constitutes your acceptance of the new Terms.
If we make material changes — for example, changes that affect your legal rights or obligations — we will post a prominent notice on the homepage for at least 30 days before the change takes effect. We encourage you to review these Terms periodically.
3. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:
- You are at least 13 years old (or the age of digital consent in your jurisdiction, if higher).
- You have the legal capacity to enter into a binding agreement under these Terms.
- You are not prohibited from using the Service under applicable law.
- If you are under 18, your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Our Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. See our Privacy Policy for details.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service. You agree not to:
- Use the Service in any way that violates applicable local, national, or international law or regulation.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Service, its servers, or networks connected to the Service.
- Introduce or attempt to introduce any virus, trojan, worm, or other malicious code to the Service.
- Scrape, mirror, or otherwise reproduce, redistribute, or republish substantial portions of our content without written permission (see Section 6 on intellectual property).
- Use automated systems (bots, crawlers, scrapers) to access the Service in a way that sends more request messages than a human can reasonably produce in the same period, except for publicly available search engines indexing the site for search results.
- Impersonate any other person or entity, or misrepresent your affiliation with a person or entity.
- Use the Service to send unsolicited communications, advertising, or promotional material.
- Frame, embed, or otherwise present the Service or any portion of it in a way that implies endorsement by ToolStep where no such endorsement exists.
Violation of any of these conditions may result in termination of your access to the Service and, where applicable, legal action.
5. The Service and Our Content
5.1 What the Service Provides
ToolStep publishes product reviews, head-to-head comparisons, best-of roundups, alternative recommendations, and related editorial content covering AI tools, software tools, and home office hardware. All content is produced by our editorial team following the methodology described on our How We Test page and the standards in our Editorial Policy.
5.2 Informational Purposes Only
All content on the Service is provided for general informational purposes only. Our reviews, ratings, comparisons, and recommendations represent our editorial opinions based on testing conducted under the conditions described on our How We Test page. They are not:
- Professional advice (legal, medical, financial, tax, engineering, or otherwise).
- A guarantee of any product's performance, safety, reliability, or suitability for your specific situation.
- An endorsement or sponsorship by any product manufacturer or brand, unless explicitly stated.
- A substitute for independent research, professional consultation, or your own judgment.
You are solely responsible for any decision you make based on content from the Service, including any purchase decision. We encourage you to verify product specifications, prices, and availability directly with the retailer or manufacturer before purchasing.
5.3 Pricing and Availability
Product prices, availability, and specifications shown on the Service are accurate to the best of our knowledge at the time of publication, but may change without notice. We do not control retailer pricing or inventory. Always verify the current price and terms on the retailer's site before completing a purchase.
6. Intellectual Property
6.1 Our Rights
The Service and its original content, features, and functionality — including reviews, comparison tables, scoring methodology, page layouts, graphics, logos, and the ToolStep name — are owned by ToolStep and protected by international copyright, trademark, and other intellectual property laws.
Trademarks, service marks, and brand names appearing on the Service (including product manufacturer names and logos) are the property of their respective owners. Reference to or display of any third-party trademark on the Service does not imply endorsement, sponsorship, or affiliation with ToolStep.
6.2 Limited License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and view the Service for your personal, non-commercial use.
- Print or download a single copy of any article for your personal records.
- Share links to our articles on social media, in forums, or in private messages, provided the link points back to the original page on the Service and you do not misrepresent the content as your own.
6.3 Prohibited Uses
You may not, without our prior written consent:
- Republish, redistribute, or reproduce more than 100 words of any article in any form.
- Use any content from the Service in a competing review site, comparison site, or commercial product.
- Remove or alter any copyright, trademark, or attribution notice from any content.
- Use automated tools to scrape, extract, or store our content in a database for redistribution.
- Use the ToolStep name, logo, or brand in a way that implies endorsement of your products or services.
If you wish to license or republish our content for commercial use, contact partnerships@toolstep.com.
7. Affiliate Links and Advertising
The Service is reader-supported and contains affiliate links and advertising. When you click certain links on the Service and make a purchase, we may earn an affiliate commission at no additional cost to you. This is described in detail on our Affiliate Disclosure page.
Our affiliate relationships do not influence our editorial ratings or recommendations, as documented in our Editorial Policy. However, you should be aware that we may earn a commission on some purchases made through the Service.
The Service may also display advertisements served by third-party advertising networks, including Google AdSense. These networks may use cookies and similar technologies to serve ads based on your prior visits to this and other websites. See our Privacy Policy for information on cookies and how to opt out of personalized advertising.
8. Third-Party Links and Content
The Service contains links to third-party websites (retailers, manufacturers, partners) and may embed or reference third-party content. We do not control, and are not responsible for, the content, accuracy, privacy practices, or availability of any third-party site. You access third-party sites at your own risk.
Inclusion of a link to a third-party site does not constitute endorsement by ToolStep. We may link to products or services we do not recommend, for the purpose of comparison or so that you can verify a product we have reviewed negatively.
9. User-Generated Content
If the Service ever enables comments, forum posts, or other user-generated content (UGC), you agree that any UGC you submit is your original work and does not violate any third-party rights. You grant ToolStep a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, and display that UGC in connection with the Service.
We reserve the right to remove, edit, or decline to publish any UGC at our discretion, without notice.
10. Disclaimers
10.1 No Warranty
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ToolStep AND ITS AUTHORS, EDITORS, AND AFFILIATES DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
- WARRANTIES THAT THE INFORMATION IS ACCURATE, COMPLETE, OR CURRENT.
- WARRANTIES REGARDING THE PERFORMANCE OR RELIABILITY OF ANY PRODUCT REVIEWED ON THE SERVICE.
We do not warrant that any product we recommend will function as described in our review, or that it will be suitable for your specific needs. Product performance may vary based on usage, environment, manufacturing tolerances, and firmware or software updates applied after our review was published.
10.2 No Professional Advice
Content on the Service does not constitute professional advice. If you require professional advice — for example, ergonomic advice for a medical condition, legal advice on a software license, or financial advice on a large purchase — consult a qualified professional in your jurisdiction.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ToolStep, ITS AUTHORS, EDITORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY CONTENT ON IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ToolStep HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Because some jurisdictions do not allow the exclusion or limitation of certain damages, the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You acknowledge that our reviews are based on testing conducted under specific conditions and that we cannot predict how a product will perform for you under different conditions. Any purchase decision based on our content is made at your own risk.
12. Indemnification
You agree to indemnify, defend, and hold harmless ToolStep, its authors, editors, employees, contractors, and affiliates from and against any claim, demand, action, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service or violation of these Terms.
- Your violation of any third-party rights, including intellectual property or privacy rights.
- Any user-generated content you submit to the Service.
- Any purchase decision you make based on content from the Service.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.
13. Termination
We may suspend or terminate your access to the Service at any time, without notice, if we believe you have violated these Terms or for any other reason at our sole discretion. On termination, all licenses granted to you under these Terms will immediately cease.
The following sections survive termination: Section 5 (Informational Purposes), Section 6 (Intellectual Property), Section 10 (Disclaimers), Section 11 (Limitation of Liability), Section 12 (Indemnification), and Section 15 (Governing Law).
14. Geographic Restrictions
The Service is operated from the United States. We make no representation that the Service is appropriate or available in locations outside the United States. If you access the Service from outside the United States, you do so at your own initiative and are responsible for compliance with applicable local laws. We do not target the Service to users in jurisdictions where its content would be illegal.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in San Francisco County, California, for any dispute arising out of or related to these Terms or the Service.
Before initiating litigation, you agree to first contact us at legal@toolstep.com and attempt to resolve the dispute informally for a period of 30 days. If the dispute is not resolved within that period, either party may initiate formal proceedings.
If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits any legal rights you may have under those laws that cannot be waived by contract.
16. Entire Agreement
These Terms, together with our Privacy Policy and Affiliate Disclosure, constitute the entire agreement between you and ToolStep regarding your use of the Service. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
